These terms cover the SkyRoads game and https://skyroads.games. They set out the rules for using the game and the website. SkyRoads is free and has no in-app purchases.
1. Publisher and scope
The publisher of the game, the supplier of its digital content and the provider of the website is Samsufi sp. z o.o., address: ul. Jagiellońska 4A, 19-120 Knyszyn, Poland, entered in the register of entrepreneurs of the Polish National Court Register (KRS) under number 0000901262, EU VAT: PL5423435334, referred to as “we” or “the publisher”.
For the game and complaints, contact support@samsufi.dev. For personal data matters, contact privacy@samsufi.dev. We do not run a telephone helpline; email is our contact channel. These details are available before you conclude a contract, in these terms and on skyroads.games.
The first release is for Android and will be distributed through Google Play as pl.samsufi.skyroads, version 1.0.0. The game has not yet been released; a closed test on Google Play is planned first. These terms describe the launch version. An iOS version is planned and has not been released. References to iOS describe planned arrangements and will apply only once that version is available; before then we will update these terms with any iOS-specific details.
2. The game, website and requirements
SkyRoads is a single-player real-time strategy game. You connect strongholds on floating islands with roads, send knights and capture the buildings of computer-controlled rivals. The game includes a campaign of 5,000 levels, Daily and Weekly Challenges, events, achievements, ranks, statistics and cosmetic items earned through play. It does not offer multiplayer, chat, leaderboards, publisher-operated user accounts, forms or user-generated content, and it does not use Google Play Games. The website presents the game and links to samsufi.dev and, once the game is available, to its store pages.
The game and website are available in several languages, including Polish and English. The legal documents are available in Polish and English.
The game requires a device running Android 8.0 (API level 26) or newer. To use the website, you need a web browser. The whole game, including all levels, works without an internet connection. Downloading and updating the game and displaying ads require an internet connection. Any connection charges are governed by your agreement with your network provider.
These terms are available free of charge before a contract is concluded, in a form that you can save and reproduce, on skyroads.games. The game's store page will link to the website.
The contract for use of the game on these terms is concluded when you download the game and start using it. Using the game is separate from advertising consent and does not imply any consent to ads, tracking or personalisation; you make those choices separately in the consent form described in the Privacy Policy.
You can stop using the website by closing it, and stop using the game at any time by closing or uninstalling it. Doing so ends the contract for use of the game; no payment is involved.
3. User age
The game is intended for people aged 13 and over. It is not directed at children under that age and does not participate in the Google Play Families programme.
The game does not ask users for their age. Identifying the intended audience as 13+ does not verify age or constitute consent to personalised advertising.
If you do not have full legal capacity to enter into contracts, use the game with a parent’s or guardian’s permission where the law applicable to your situation requires it. Turning 13 does not automatically allow you to enter into every contract or give every type of data consent independently. In Poland, the child consent threshold under Article 8 GDPR is 16. Data processing and advertising are explained in the Privacy Policy.
4. Licence and intellectual property
The publisher grants you a free, non-exclusive licence to download and use the game personally in accordance with these terms and the rules of the store from which you obtain it. Earning stars, achievements, ranks or cosmetic items gives you the right to use them in the game; it does not transfer copyright in the game or its elements.
Rights in the game and the publisher’s materials belong to the publisher. Rights in third-party software, fonts, sounds, trade marks and other elements remain with their respective right holders. Their separate licences continue to apply.
You must not distribute the game without permission, sell copies or use its elements in breach of intellectual property rights. These restrictions do not cover acts permitted by mandatory law, including legally permitted examination of the program’s operation or decompilation, or acts allowed by the licences of its components. Section 11 also addresses the licence for the future iOS version.
5. Rules of use
- Use the game, website and third-party services lawfully.
- Do not interfere without authorisation with security measures or the operation of services.
- Do not distribute modified versions of the game or present them as SkyRoads.
- Do not send unlawful content or malicious software, including in messages to support.
- Do not impersonate someone else or infringe their rights.
These rules do not restrict your ability to exercise statutory consumer rights, report a fault or exercise personal data rights.
6. Free gameplay and ads
The game is free. It has no in-app purchases, no paid currency, no paid ad removal and no pay-to-win features. Everything in the game, including Embers, Kingdom Commission rewards and cosmetic items, is earned through play, has no monetary value and cannot be bought, sold or exchanged for money. Cosmetic items do not change battle rules.
The launch version contains full-screen Google AdMob interstitial ads. Ads may appear only after a won battle, on the result screen, after the result and rewards have been saved. Only won battles count: an ad slot falls after the fifth win and then after every third win. A slot is skipped, not postponed, if you have not yet reached campaign level 10, if the battle was a Daily Challenge, Weekly Challenge or event battle, or if less than three minutes of active play have passed since the previous ad closed. No ad appears during a battle, after a loss, at launch or on exit. There are no banner ads or rewarded ads.
Without an internet connection, or if no ad is ready, the game continues normally without an ad. Ads never affect rewards, stars, progress or events. Advertising consent, protections for minors and changing your choice through Settings → “Privacy options” are explained in the Privacy Policy. Using the game is not consent to tracking or personalised advertising.
7. Conformity of the game with the contract
We are responsible for supply and conformity of digital content or services to the extent required by our contract with you and by law. This includes requirements concerning functionality, compatibility, security and updates. Statutory protection may also cover a contract without a monetary price, such as this one, where a consumer provides personal data used for purposes other than performing the contract itself or meeting a legal obligation, for example for personalised advertising.
Where the Polish Consumer Rights Act applies:
- For a single act or a series of individual acts of supply, such as the game and its updates, we are responsible for a lack of conformity existing at supply that becomes apparent within two years. A lack of conformity appearing within the first year benefits from the statutory presumption that it existed at supply.
- For continuous supply, we are responsible for a lack of conformity occurring or becoming apparent during the period in which the supply is due.
- We provide necessary updates, including security updates, and inform you about them for the period required by law: throughout continuous supply, or for a reasonably expected period in the case of a single act or a series of individual acts of supply.
- You may require the content or service to be brought into conformity free of charge, within a reasonable time and without significant inconvenience. Refusal is permitted only in circumstances provided by law.
- You may terminate the contract under the statutory conditions, including where conformity cannot be restored, has not been properly restored, the problem persists despite an attempt to remedy it, or it is serious enough to justify immediate termination. Because you pay no price, the rule excluding termination for a minor lack of conformity, which applies to paid supplies, does not apply.
If the content or service has not been supplied, you may require supply and exercise the statutory right to terminate, or terminate without an additional request in circumstances provided by law. Personal data is handled under the GDPR as described in the Privacy Policy. Detailed rights are set out in Chapter 5b of the Polish Consumer Rights Act, which implements Directive (EU) 2019/770. Consumer protection laws in your country may provide additional rights.
8. Complaints
You may send a complaint about the game, website or the publisher’s supplies to support@samsufi.dev. Describe the problem and the remedy you seek and, where helpful, provide your device model, operating system and game version. These details help investigate the matter; we do not require your account password or other unnecessary data.
We respond to a consumer complaint within 14 days of receiving it, unless a specific applicable legal provision provides otherwise. We provide the response on paper or another durable medium, such as email. Where Article 7a of the Polish Consumer Rights Act applies, failure to respond within the statutory period means the complaint is accepted. This is the response deadline, not a promise to complete every repair within that time.
Store distribution of the game does not exclude our liability under law or contract. Claims against the store may also be addressed to it through its relevant support channel.
9. Saves, third-party services and availability
Progress, settings and statistics are saved locally on your device. “Reset progress” in the game's menu clears your progress while keeping most settings. Clearing app data or uninstalling removes local data. If Android device backup is enabled, Android may keep a copy of your saved progress in your Google Account and restore it when you reinstall the game; an unfinished battle is not included in that backup. The Privacy Policy explains data deletion. We cannot restore progress lost on your device, because we do not hold a copy of it.
Ads, the store and Android backup are operated by third parties. Their operation also depends on their systems, your account with the provider and the network connection. The relevant service terms apply. The game works without a Google Account backup and without ads.
We do not promise uninterrupted availability of third-party services. However, their failure or withdrawal does not remove statutory claims concerning features we have agreed to supply. A provider’s changes alone do not automatically release us from liability.
10. Updates, changes and discontinuation
Necessary fixes to maintain conformity are governed by section 7. Changes going beyond that purpose require an appropriate contractual basis and must respect existing rights.
We may change continuously supplied features (such as the website or the advertising and consent integration) or these terms only for the following reasons:
- changes in the law or in decisions of public authorities;
- changes in the requirements of operating systems or app stores;
- changes in the technical interfaces of providers whose services are necessary for the game to work, such as Google or Apple;
- security reasons.
We will inform you of such a change at least 30 days before it takes effect, in the game or on skyroads.games, and also by email if we have your email address. If you do not accept the change, you may terminate the contract, in particular by stopping use of the game and uninstalling it.
Where Articles 43p–43q of the Polish Act apply, a change not required to maintain conformity must not create additional costs. Information must be clear, and if the change has a significant negative effect on access or use, it must be provided sufficiently in advance on a durable medium. The consumer may then terminate without a notice period within 30 days of the change or of later notice of it, unless they can retain the unchanged, conforming supply at no additional cost. This power to make changes does not apply to content or services supplied in a single act.
If we decide to discontinue the game, we will announce it at least 30 days in advance in the game or on skyroads.games. Discontinuing the game does not cancel obligations under existing contracts or statutory conformity duties. Because the game works offline and stores progress on your device, an installed copy can usually continue to be played. Merely publishing new terms does not retrospectively change existing rights or automatically amount to a user’s agreement to change an ongoing contract.
11. Planned iOS version and Apple’s licence
For the game downloaded from the App Store, Apple’s standard Licensed Application End User License Agreement will apply, supplemented by these terms. For a third-party app, the licensor is its publisher. These terms supplement information about SkyRoads, complaints and consumer rights; we do not use a custom EULA in place of the standard licence.
Apple remains responsible for its own obligations under store terms and applicable law. The publisher provides help with the operation of SkyRoads through support@samsufi.dev. Neither the licence nor these terms restrict mandatory consumer rights. Progress will not be transferred between Android and iOS.
12. Liability and governing law
The publisher’s liability is governed by applicable law. These terms do not exclude liability that cannot lawfully be limited and do not remove a consumer’s remedies for a lack of conformity.
Polish law governs the contract with the publisher. If you are a consumer, this choice does not deprive you of protection under mandatory provisions of the law that would apply without that choice, in particular the law of your habitual residence. We do not impose the exclusive jurisdiction of Polish courts; jurisdiction is determined by applicable rules.
Consumer protection provisions also apply to people whom the law grants particular consumer rights even though their contract relates to a business activity, to the extent provided by that law.
13. Out-of-court dispute resolution and contact
You may seek help from a consumer ombudsman, relevant alternative dispute resolution bodies and, for cross-border matters, a European Consumer Centre. Information and directories are available from UOKiK and the European Commission.
If a complaint does not resolve the dispute, we will provide the legally required statement on a durable medium about whether we agree to participate in an out-of-court procedure and, where required, information about the competent body. Your right to go to court remains. The former EU ODR platform has closed and is not available for new complaints.
Send questions about these terms and the publisher’s supplies to support@samsufi.dev, and personal data questions to privacy@samsufi.dev.
